The Ternopil Regional Office has restored a nonresidential building into a state-owned due to litigation

On 12.04.2018 due to the ruling of the Cassation Economic Court, which is included in the Supreme Court of Ukraine, the cassationappeal of the Regional Office was satisfied and whereby the right of ownership of a nonresidential building of chlorination plant (is located at the address: 3"Х", Pavlo Tychyny st., Buchach town, Buchach district) was recognized off the State in the person ofthe Ternopil Regional Office of theSPFU.

On 19.05.2017 the Regional Office appealed to the Ternopil Economic Court with the claim to OJSC “Buchatskii Sugar Plant” on the recognition of the property rights on a nonresidential building of chlorination plant by the State in the person ofthe Regional Office.

The decision of the Ternopil Economic Court dated June 20, 2017, which was left unchanged by the decision of the Lviv Appeal Economic Court dated 27.09.2017, was denied a satisfactory claim of the Regional Office.

On 31.10.2017having availed oneself of one's lawful right for appealing of decisions of the court, mentioned above, the Regional Office addressed with a cassation appeal in which asked to cancel the decisions of the local and appellate judges and to take a new decision to recognize the right of state property to real estate, at that time not yet eliminated the Higher Economic Court of Ukraine
